Terms of Service

Please read these Terms carefully. They are a binding agreement between you and [LEGAL_ENTITY_NAME] ("LekSync", "we", "our", "us"), operator of the LekSync application and the website at leksync.in. By using LekSync you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, accessing or using LekSync (the "App") or visiting our website (together, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use LekSync (or the higher minimum age for digital consent where you live). If you are under 18, you may use the Service only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service you represent that you meet these requirements.

3. Your Account

• You are responsible for keeping your account credentials secure and for all activity under your account.
• You must provide accurate, current and complete information when signing up and keep it updated.
• You must not impersonate another person, misrepresent your identity, or create an account on behalf of someone without their authorisation.
• One natural person may register only one primary account.
• Notify us promptly at leksync.official@gmail.com if you suspect unauthorised access.

4. Acceptable Use

You agree not to, and not to allow anyone on your device to:

• Use LekSync to stream copyrighted music, video, or other content you do not have the right to share.
• Stream illegal, hateful, harassing, defamatory, obscene, sexually-explicit involving minors, or otherwise unlawful content.
• Use the live microphone feature (in either direction — host to receivers, or receiver to host) to harass, threaten, defraud, or broadcast unlawful content.
• Scan or use a Wi-Fi hotspot QR code to join a network without the network owner's clear permission. Unauthorised access to a Wi-Fi network may violate local law regardless of how the credentials were obtained.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except where this restriction is prohibited by mandatory applicable law.
• Use automated scripts, bots, crawlers, scrapers, or other programmatic means to access the Service.
• Circumvent device limits, abuse referral codes, exploit bugs for unauthorised Premium access, or otherwise defraud the referral or subscription systems.
• Join an online room you have not been invited to, or attempt to brute-force, guess, or enumerate room codes.
• Interfere with, disrupt, overload, or probe the Service or networks connected to the Service.
• Introduce viruses, malware, or any other harmful code; or attempt to gain unauthorised access to any part of the Service or the accounts of other users.
• Use the Service in any way that violates applicable law, including export-control, sanctions, data-protection, and intellectual-property laws.

5. Music, Video and User Content

LekSync does not host, distribute, own, or cache any music or video files. The App plays and streams media that exists on your own device. You retain all rights to your content; LekSync makes no claim of ownership.

You are solely responsible for ensuring you have all necessary rights and permissions to play, share, or stream any content through LekSync. We are not liable for any copyright or other infringement caused by your use of the Service.

Copyright complaints. If you believe content streamed via LekSync infringes your rights, email leksync.official@gmail.com with (a) identification of the work, (b) the room or session details, (c) your contact information, (d) a statement of good-faith belief, and (e) a statement under penalty of perjury that the notice is accurate and you are authorised to act. We will remove or restrict access where appropriate and may suspend repeat infringers.

6. Subscriptions and Billing

• LekSync is free to download. Optional Premium tiers unlock additional features such as higher receiver limits.
• All paid subscriptions are processed through Google Play Billing. We do not receive your card number, CVV, or any payment instrument.
• Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date through Google Play.
• Pricing, duration, and benefits of each plan are shown in-App before purchase. Prices may change; changes apply only to future billing periods and you will be notified in advance.
• Refunds are governed by our Refund Policy and by Google Play's terms.

7. Free Trials and Referrals

Free trials granted via referral codes or promotions are for introductory purposes, have no cash value, are non-transferable, and expire on the stated date. We reserve the right to modify, suspend, or end a promotion at any time, and to revoke benefits obtained through fraud, abuse or self-referral.

8. Service Availability; No Guarantee

We aim to keep LekSync running smoothly but we do not guarantee uninterrupted, error-free, or secure access. We may change, suspend, or discontinue any part of the Service (including features, online-room routing, and plan limits) at any time for maintenance, upgrades, security, legal or operational reasons. Where we stop a paid feature permanently, we will pro-rate the remaining paid period.

9. Termination

You may stop using the Service and delete your account at any time through the in-App account-deletion flow. We may suspend or terminate your account, with or without notice, if you breach these Terms, engage in conduct that harms other users or the Service, or where we are required to do so by law. Sections of these Terms that by their nature should survive termination (including §5, §10–§16) will survive.

10. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uninterrupted or error-free operation, or security. No advice or information, oral or written, obtained from us creates any warranty not expressly stated here.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• LekSync will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service — even if we were advised of the possibility of such damages.
• Our total aggregate liability for all claims relating to the Service in any twelve-month period is capped at the greater of (a) the amount you paid us in that period or (b) INR 500.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded under applicable law.

12. Indemnification

You agree to defend, indemnify and hold harmless LekSync, its affiliates, officers, employees and agents from and against any claims, damages, losses, liabilities, costs or expenses (including reasonable legal fees) arising out of or relating to (i) your use of the Service, (ii) your violation of these Terms, (iii) your violation of any applicable law or the rights of any third party, or (iv) any content you stream through the Service.

13. Intellectual Property

LekSync, the LekSync logo, and all associated names, designs, icons, and code are our intellectual property. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on any device you own or control, for your personal non-commercial use. All rights not expressly granted are reserved.

14. Third-Party Services and Links

The Service relies on third-party services (including Google Firebase and Google Play Billing) and may link to third-party websites. We are not responsible for third-party content or practices; your use of third-party services is governed by their terms and privacy policies.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and notify you via the App or by email. Continued use of the Service after the updated Terms take effect constitutes acceptance.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. The courts of [CITY, INDIA] shall have exclusive jurisdiction over any dispute arising from or relating to the Service or these Terms, subject to any mandatory consumer-protection rights you have under your local law. Nothing in this section deprives you of the protection afforded to consumers by the mandatory law of the country in which you reside.

17. General

• Entire agreement. These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and LekSync concerning the Service and supersede any prior understanding.
• Severability. If any provision is held unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
• No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
• Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms to a successor in connection with a merger, acquisition, reorganisation, or sale of assets.
• Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, acts of government, power or internet outages, or third-party service failures.
• Notices. We may give notice to you via the App, by email to the address on your account, or by posting on our website. You may give notice to us at leksync.official@gmail.com.
